Acceptable Usage Policy
Introduction
This Acceptable Use Policy (AUP) governs the use of internet services (“Services”) provided by Optika in the Republic of South Africa. This AUP is designed to ensure compliance with the laws and regulations applicable to Optika and to protect the security, integrity, and reliability of the Optika’s network.
Compliance with Laws
All Users of the Services must comply with all applicable laws, including but not limited to the Electronic Communications and Transactions Act, 2002, the Regulation of Interception of Communications and Provision of Communication-Related Information Act, 2002, and the Protection of Personal Information Act, 2013
Prohibited Activities
Users may not use the Services to engage in activities that are illegal, infringing, or harmful to others. This includes, but is not limited to:
- Illegal activities: The transmission, distribution, or storage of any material in violation of any applicable law or regulation.
- Infringement: Infringing on the intellectual property rights of others, including copyrights, trademarks, patents, or trade secrets.
Harmful activities: Transmitting material that may be harmful to minors, transmitting threatening material, or transmitting material that supports racism, bigotry, or discrimination.
Security
Users are responsible for ensuring the security of their own systems and Optika’s network. This includes using secure passwords, keeping systems updated, and not engaging in activities that may compromise network security. Users must not:
Access or attempt to access the accounts of others, or penetrate or attempt to penetrate the Provider’s or another entity’s security measures.
Distribute viruses, worms, Trojan horses, or other harmful software.
Email and Communication Policies
Users must not use the Services to send bulk unsolicited emails (spam) or messages that may impact the use of the network by other Users. All emails sent using the Services should comply with applicable laws, including the Consumer Protection Act, 2008.
Fair Usage
Optika aims to provide a fair and efficient service to all its users. Users must not use the Services in a manner that unreasonably interferes with the fair and efficient use of the network by others. This includes using significant bandwidth that affects the network performance for other users.
Monitoring and Enforcement
Optika reserves the right to monitor compliance with this AUP. In the event of a breach, Optika may take any action it deems appropriate, including but not limited to, temporary suspension of service, permanent termination of service, and legal action.
Modifications to the AUP
Optika reserves the right to modify this AUP at any time.
Liability
The User agrees to indemnify and hold harmless Optika from any claims resulting from the use of the Services that damages the User or another party.
